  2. If you are stopped for a DUI, refusing the breath test is a separate criminal charge and results in an automatic one-year suspension of your driver’s license. 

  3.   Refusal does not mean you won’t be charged or convicted for DUI.   

  4.   Your third or more DUI charge will be a felony criminal charge and subject to higher penalties. 

  5.   You face up to a year in prison and fines up to $100,000. 

  6.   You could also be ordered to attend in-patient alcohol treatment if the court thinks you need it.
